WeLNES Privacy Statement

WeLNES (“We” or “Us” or “Our”), a research study of the WeLNES programs for weight loss, nutrition, and exercise at the Fred Hutchinson Cancer Center in Seattle, Washington, takes your privacy seriously. Please review Our Privacy Policy carefully. This Privacy Policy explains how We collect, use, disclose, and safeguard the information you provide Us. This Privacy Statement covers Our telephone weight loss research (“Programs or “Services”) solely for the WeLNES clinical trials. By participating in the WeLNES programs or otherwise providing your information to Us, you accept this Privacy Policy. If you have questions about this policy, please let us know.

INFORMATION WE COLLECT

During the course of these Services (including the study website, online surveys, telephone calls, email and text reminders, and other research services), We collect personal information which is identifiable and non-identifiable (de-identified) from and about you when you provide it to us and automatically, such as when you use Our Site (Our study website and online surveys,) and when you give Us permission to access your Fitbit data (including Aria Air scale, Inspire physical activity tracking, and food logging data). The collection of personally identifiable information is governed by the signed research consent form approved by the Fred Hutchinson Cancer Center’s Human Subjects Internal Review Board. Examples of non-personal information include, but are not limited to, anonymous usage data or the number of calls you complete. Examples of personally identifiable information may include your email address, mailing address, and Fitbit user profiles.

HOW WE USE PERSONAL INFORMATION

User Information The WeLNES Programs uses your personal information to create an engaging and effective experience for weight loss program participants (Users). We may also use your identifiable information to improve the structure or delivery of WeLNES program. The collection of personally identified information is governed by the signed research consent form approved by the Fred Hutchinson Cancer Center’s Human Subjects Internal Review Board.

Communications We may use your identifiable information to respond to you, to provide what you requested, to update you with changes to Our Privacy Statement or Terms and Conditions.

Research We may use your identifiable information (information that is linked to your study identification number) to measure WeLNES’s impact and effectiveness to Users, and continue Our research, which may result in published reports or articles, which will include only de-identified information.

HOW WE PROTECT YOUR PERSONAL INFORMATION

The section of the research study consent entitled “Protecting your Privacy as an Individual and the Confidentiality of Your Personal Information” describes how Fred Hutch Cancer Center and the applicable researchers will use, process, and protect your personally identifiable information collected from and about you in connection with the Research Study.

Your identifiable information is protected both online and offline. Personally identifiable information is encrypted and transmitted in a secure manner. Our computers and servers containing this information are kept in secure environments. Access to your data is granted only to employees of the Fred Hutchinson Cancer Center and affiliates with the need to access your information for the purposes of these Program services.

We store personal information and other data for as long as it is allowed by the Fred Hutchinson Cancer Center’s Human Subjects Internal Review Board.

DISCLOSURE OF YOUR PERSONAL IDENTIFIABLE INFORMATION

We may disclose aggregated information that does not identify you without restriction. In addition, We may disclose your personal information or other information about you as follows: (a) If you are a research study participant, as described in the research study consent, including to the researchers listed therein. (b) To contractors, service providers, and other third parties We use to support the Research Study and who are bound by contractual obligations to keep personal information and other information about you confidential and use it only for the purposes for which We disclose it to them. (c) To comply with any court order, law, or legal process, including to respond to any government or regulatory request. (d) To enforce Our rights arising from any contracts entered into between you and Us. (e) If We believe disclosure is necessary or appropriate to protect the rights, property, or safety of any individual or entity. (f) To fulfill the purpose for which you provide it. (g) For any other purpose with your consent, including the research study consent.

MISCELLANEOUS PROVISIONS

Devices We may collect information from or about the computers, phones, or other devices where you access your surveys, depending on the permissions you've granted. For example, We may collect information such as the name of your mobile operator or ISP, browser type, language and time zone, and IP address.

Cookies We may use cookies and similar technologies to provide support of WeLNES.

Legal Proceedings We may disclose your Personal Information in response to a court or administrative order, subpoena, discovery request, or other lawful processes.

Your Rights We are required by law to: (1) protect the privacy of your personal information; (2) provide you this notice explaining Our responsibilities and privacy practices when We collect your Personal Information; (3) notify you of a breach of unsecured Personal Information; and (4) follow the terms of Our Notice.

UPDATES TO PRIVACY STATEMENT

We will notify you through Our Website of any significant changes made to Our privacy practices by updating Our Privacy Statement, and include the opportunity to stop using WeLNES.
